Stars forward Ryan Garbutt will have a hearing with the NHL for his hit on Anaheim\u2019s Dustin Penner in Sunday night\u2019s game, but when the hearing will be held is still up in the air.

Stars forward Ryan Garbutt will have a hearing with the NHL for his hit on Anaheim’s Dustin Penner in Sunday night’s game, but when the hearing will be held is still up in the air.

“The league has two or three (hearings) today, so they are waiting to get through those to see where they are at,” Stars GM Jim Nill said. “The league will call me later today or early tomorrow.”

The league has offered Garbutt an in-person hearing, which means the suspension could top five games. The league is looking at charging and an illegal check to the head as infractions on the play, which knocked Penner out of the game. Nill said he didn’t want to comment on the hit.

“It’s a fast game out there and things happen,” Nill said. “I’d rather not comment on it.”

Lehtonen activated

The Stars activated goaltender Kari Lehtonen from injured reserve on Monday and assigned Jack Campbell to the Texas Stars of the AHL.

That’s a sign that Lehtonen, who has missed the last five games with a lower body injury, should be ready for the Stars’ next game, which is Thursday versus Calgary at American Airlines Center.

“We’re anticipating he’ll be ready Thursday, yes.” Nill said of Lehtonen.

Roster situation

If Ryan Garbutt is suspended, he’ll remain on the active roster. Aaron Rome, who has been on a conditioning assignment, has been on the active roster as well.

So, the Stars are at 23 players and have no room for moves other than the goaltender change and bringing Rome back from his conditioning assignment, which they did Monday afternoon. Rome will be at practice Tuesday morning in Frisco.

With Rome being recalled the Stars will have 13 forwards (12 eligible if Garbutt is suspended), 8 defensemen and 2 goaltenders for a full 23-man roster.

Nill on the Stars season so far

The Stars have seen some ups and downs over the first eight games of the season, posting a 3-5-0 record. They had a big win over San Jose on Thursday and then followed it up with a 5-2 loss in Los Angeles on Saturday and then a 6-3 loss in Anaheim on Sunday.

Stars GM Jim Nill gave a brief assessment about his team’s start to the season Monday afternoon.

“We’ve done some great things, we’ve had some stinkers, periods where we’ve been great, periods where we’ve been bad,” Nill said. “We’ve got some players who have bad habits that need to be broken. It’s been years of bad habits and that needs to get changed. I think we’ve got some older guys that need to play a lot better, some of our veterans need to step up and play better, too. It’s kind of a combination.

“On top of it, we’ve had our No. 1 goalie out for five games. It’s a tough league. Dan (Ellis) and Jack (Campbell) have come in and played great, but for the long haul you still need your No. 1 goalie.”
